Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Oracolarium platform, website at oracolarium.com, and all related services (collectively, the "Platform"), operated by Ecliptio Ltd, a company registered in Malta (Company Registration Number: C111698), with registered office at Northlink Business Centre Level 2, Triq Burmarrad, Naxxar, NXR 6345, Malta, VAT Number MT31906033 (hereinafter referred to as "Ecliptio", "we", "us", or "our").

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. We reserve the right to update these Terms at any time. We will notify registered users of material changes via email at least 30 days before changes take effect. Continued use after the effective date constitutes acceptance.

2. Definitions

  • "Content" means oracle card decks, guidebooks, card images, AI-generated readings, natal chart interpretations, and any other material available through the Platform.
  • "Creator" means a user who publishes oracle card decks on the Platform under a separate Creator Agreement.
  • "Deck" means a set of oracle cards with associated imagery, guidebook entries, AI persona configuration, and spread definitions.
  • "Reading" means an AI-generated interpretive session using one or more oracle cards, powered by artificial intelligence.
  • "Natal Chart" means an astrological birth chart calculated using astronomical ephemeris data, with AI-generated interpretation.
  • "Subscription" means a recurring paid plan (Plus or Premium) granting enhanced access to Platform features.
  • "Reading Set" means a house-branded physical product comprising printed oracle cards, sold from stock.
  • "Oracolarium Edition" means a physical printed version of a Creator's digital deck, manufactured on demand (print-on-demand) upon each individual order.
  • "Official Edition" means a Creator's own physical product, purchased through the Platform and fulfilled by the Creator.
  • "AR Content" means augmented reality overlays, animations, and interactive content associated with AR Premium decks.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Accounts

4.1 Registration

To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4.2 Account Security

You must notify us immediately at support@oracolarium.com if you become aware of any unauthorized use of your account. We are not liable for losses arising from unauthorized use of your account.

4.3 Account Termination

You may delete your account at any time through the Platform settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

5. Platform Services

5.1 Free Tier

Free accounts include access to a limited number of daily readings and selected house decks, as specified on the Platform. Free tier features and limits may change at our discretion.

5.2 Subscription Plans

The Platform offers paid subscription plans ("Plus" and "Premium") with enhanced features as described on the pricing page. Subscription fees are charged monthly via Stripe. All prices are in Euros (EUR) and include applicable VAT where required. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

5.3 One-Time Purchases

Users may purchase individual decks, natal chart readings, and physical products as one-time transactions. All one-time purchases are final and non-refundable except as required by applicable consumer protection law (see Section 9).

5.4 Physical Products

The Platform offers three types of physical products, each with different fulfilment and return policies as described in Section 9.4:

  • Reading Sets: house-branded oracle card sets, shipped from stock.
  • Oracolarium Edition: printed versions of Creator decks, manufactured on demand (print-on-demand) for each individual order.
  • Official Edition: Creator's own physical product, purchased through the Platform and fulfilled directly by the Creator.

6. AI-Generated Content Disclaimer and Non-Reliance

IMPORTANT: All readings, interpretations, natal chart analyses, and other AI-generated content on the Platform are produced by artificial intelligence for entertainment, personal reflection, and self-exploration purposes only.

6.1 Nature of AI Content

AI-generated content on the Platform:

  • Does NOT constitute professional advice of any kind, including but not limited to psychological, medical, financial, legal, or therapeutic advice
  • Should NOT be used as a substitute for consultation with qualified professionals
  • May contain inaccuracies, inconsistencies, or hallucinations inherent to AI technology
  • Is NOT deterministic and may produce different results for the same input
  • Should be treated as a creative and reflective tool, not as factual or predictive guidance

6.2 Non-Reliance

You explicitly acknowledge and agree that:

  • Any AI Persona associated with a Deck is a role-playing configuration and does not possess consciousness, spiritual insight, foresight, or any form of sentience
  • The Platform does not claim to predict the future, influence reality, or provide supernatural guidance
  • You shall not base financial investments, medical choices, legal actions, or other consequential life decisions on Content generated by the Platform
  • Any actions you take based on AI-generated Content are entirely at your own risk and discretion

6.3 Natal Chart Disclaimer

Natal chart calculations are performed using the Swiss Ephemeris astronomical library for maximum accuracy of planetary positions. However, the AI-generated interpretations of these positions are for entertainment and personal reflection purposes only. Astrological interpretations are not scientifically validated and should not be treated as factual assessments of personality, compatibility, or life trajectory.

If you are experiencing a mental health crisis, please contact a qualified mental health professional or your local emergency services immediately. The Platform is not a substitute for professional care.

7. Augmented Reality (AR) Content

AR Premium features use device camera access to overlay digital content on physical oracle cards. By using AR features, you grant the Platform permission to access your device camera solely for the purpose of card recognition and AR content display. No images or video from your camera are stored, transmitted, or processed beyond real-time on-device card recognition.

8. Intellectual Property

8.1 Platform IP

The Platform, including its design, code, AI models integration, reading engine, design system, and branding, is the intellectual property of Ecliptio Ltd. You may not copy, modify, distribute, or create derivative works of the Platform.

8.2 Creator Content

Oracle card decks published by Creators remain the intellectual property of their respective creators, subject to the license granted under the Creator Agreement. Users purchase a license to use decks for personal readings, not ownership of the underlying intellectual property.

8.3 User Content

Any content you submit (reviews, comments, shared readings) grants Ecliptio a non-exclusive, worldwide, royalty-free license to display and distribute such content on the Platform.

8.4 House Decks

Certain decks on the Platform are created by Ecliptio using AI-assisted tools ("House Decks"). While Ecliptio claims ownership of the compilation, selection, arrangement, and any human-authored elements of House Decks, users acknowledge that AI-generated imagery and text components may not be independently protectable under copyright law. Unauthorized reproduction of House Decks remains a violation of these Terms regardless of underlying copyright status.

9. Payments, Refunds, and Cancellation

9.1 Payment Processing

All payments are processed securely via Stripe. Ecliptio does not store credit card information. By making a purchase, you agree to Stripe's terms of service.

9.2 Subscription Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period.

9.3 Right of Withdrawal — Digital Content (EU Consumers)

Under EU Directive 2011/83/EU, you have 14 days from the date of purchase to withdraw from a contract for digital content.

Waiver of Right of Withdrawal for Digital Content: Before completing any digital purchase (deck, natal chart, or other digital content), you will be asked to expressly confirm the following statement via an active checkbox on the checkout screen:

"I request immediate access to this digital content and acknowledge that I thereby lose my 14-day right of withdrawal once the content has been accessed."

By checking this box and completing the purchase, you explicitly consent to immediate performance and acknowledge the loss of your right of withdrawal for that specific digital content upon first access.

9.4 Right of Withdrawal — Physical Products (EU Consumers)

Different return policies apply depending on the type of physical product:

(a) Oracolarium Edition (Print-on-Demand): Oracolarium Edition decks are manufactured on demand to your specific order. In accordance with EU Consumer Rights Directive Art. 16(c), the right of withdrawal does NOT apply to goods made to the consumer's specifications. As each Oracolarium Edition deck is printed individually upon your order, these products are excluded from the 14-day right of withdrawal. This is clearly indicated at checkout.

(b) Reading Sets (Shipped from Stock): Reading Sets are standard products shipped from existing stock. The standard 14-day right of withdrawal applies. You may return a Reading Set within 14 days of delivery, provided the product is in original, sealed, unopened condition. Return shipping costs are borne by the consumer. To initiate a return, contact support@oracolarium.com.

(c) Official Edition (Fulfilled by Creator): Official Edition products are fulfilled by the Creator. Returns are subject to the Creator's own return policy as displayed on the product listing. Ecliptio will facilitate communication between the user and the Creator but is not responsible for the Creator's return policy or fulfilment.

Defective Products (all types): Regardless of the above, if any physical product arrives damaged, misprinted, or materially defective, you are entitled to a replacement or full refund. Please contact support@oracolarium.com within 14 days of delivery with photographic evidence of the defect.

9.5 Refund Policy

Refund requests for defective digital content or defective physical products should be directed to support@oracolarium.com. We will process valid refund requests within 14 business days.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or extract source code from the Platform
  • Use automated tools (bots, scrapers) to access the Platform without written permission
  • Circumvent any access restrictions or usage limits
  • Upload or distribute malicious code, spam, or harmful content
  • Impersonate another person or entity
  • Use the Platform to harass, abuse, or harm others
  • Resell, sublicense, or redistribute Platform content without authorization
  • Use AI-generated readings to provide professional advice to third parties
  • Base financial investments, medical choices, legal actions, or other consequential decisions on AI-generated Content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECLIPTIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Without limiting the foregoing, Ecliptio expressly disclaims any liability for decisions made or actions taken by users based on AI-generated Content, including but not limited to readings, interpretations, and natal chart analyses.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ecliptio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Third-Party Services

The Platform integrates with third-party services including Stripe (payments), Anthropic Claude (AI), ElevenLabs (text-to-speech), and Wasabi (storage). Your use of these services is subject to their respective terms and privacy policies. Ecliptio is not responsible for the availability or performance of third-party services.

14. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We will make reasonable efforts to notify users of significant changes. We are not liable for any modification, suspension, or discontinuation of the Platform.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malta. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malta.

For EU consumers: Nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. You may also bring proceedings in the courts of the EU member state in which you reside.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and (where applicable) the Creator Agreement, constitute the entire agreement between you and Ecliptio regarding the Platform.
